Your Fence Might Not Be Your Boundary: The Surveying Behind Property Lines

September 4, 2026Kim Hesse

You look out the window. There’s the fence. Your yard is on this side, your neighbour’s yard is on the other.

Pretty straightforward, right?

Well… not always.

One of the more surprising things about property ownership is that the fence you can see isn’t necessarily the legal boundary of your property.

And when someone needs to work out exactly where one property ends and another begins, that’s where a Licensed Surveyor comes in.

A Fence Is Just a Fence

It’s easy to assume that wherever the fence has been built must be the boundary.

But fences can be replaced, moved or rebuilt over many decades. Sometimes they’ve been positioned to avoid a tree, retaining wall or other obstacle. Sometimes previous owners simply put them in the wrong place.

A few centimetres might not sound like much – until someone decides to build a new garage, extension, retaining wall or development right alongside it.

Suddenly, knowing exactly where the legal boundary sits becomes very important.

So, How Does a Surveyor Find a Boundary?

Unfortunately, there isn’t a giant dotted line running through the ground saying:

YOUR PROPERTY ENDS HERE.

Instead, surveyors piece together evidence.

They may examine title information and historical survey plans, search for existing survey marks, take precise measurements and compare what they find on the ground with official records.

It can be a little like detective work.

A surveyor isn’t simply measuring where the fence is today. They’re gathering and interpreting evidence to determine where the property boundary legally sits.

And in Victoria, cadastral surveys that define or re-establish property boundaries must be undertaken by a Licensed Surveyor.

What Happens If the Fence Is in the Wrong Spot?

This is where things can get interesting.

Imagine discovering that the fence you have happily mowed alongside for the past 15 years isn’t actually sitting on the property boundary.

Perhaps it’s only slightly out.

Perhaps it’s considerably out.

Or perhaps that shed, driveway or retaining wall isn’t quite where everyone thought it was either.

It doesn’t automatically mean someone needs to start moving fences that afternoon. Boundary and fencing matters can involve a range of considerations.

But before decisions can be made, one thing is essential:

Knowing where the boundary actually is.

And that’s something you don’t want to guess.

What About Apartments?

Property boundaries become even more fascinating when we stop thinking in two dimensions.

In an apartment building, for example, properties can exist above, below and beside each other.

A surveyor may be dealing with boundaries involving walls, floors, ceilings, balconies, car parks, storage areas and common property.

Modern surveying isn’t just about working out who owns which patch of grass.

Sometimes the property being defined is several storeys above the ground.

And Do You Own the View?

Here’s another interesting property question: if you’ve got a beautiful view from your home, do you own it?

Generally, no.

Owning land doesn’t automatically give you ownership of the view beyond your property. Planning controls and other legal arrangements may affect what can be built nearby, but a property boundary itself doesn’t guarantee that your view will stay exactly the same forever.

So while a surveyor can help establish precisely where your property begins and ends, they can’t necessarily protect that perfect sunset!

There’s More to That Fence Than You Think

We pass fences, boundary lines, apartment buildings and property developments every day without giving them much thought.

But behind those seemingly simple lines is an entire system that helps define land ownership and supports everything from buying a home to constructing major developments.

Surveyors combine mathematics, technology, historical records, legislation, problem-solving and plenty of investigative work to make sense of it all.

So next time you look over the back fence, remember:

It might separate you from your neighbour — but it doesn’t necessarily tell you exactly where your property ends.

And if you really need to know?

That’s a job for a surveyor.
